Terms of Use
Version: v4.0
Publication date: 2026-10-16
Application to your account: on acceptance, subject to the rules below
Last updated: 2026-10-16
For a new account, these Terms apply when you accept them during registration. For an existing account, this revision applies when you expressly agree to it, subject to any required advance notice, transition arrangements, and mandatory consumer rights. Publishing these Terms or updating the app does not itself change your existing contract. Acceptance does not waive any required notice, rights relating to a period already paid for, or statutory remedies. Section 3 explains agreement and Section 10 explains changes and termination.
These Terms govern the ARKAD Wallet mobile application and related account services (the Service), provided to individual consumers. Please read and save these Terms before creating an account or purchasing Premium. The Polish version is provided for our Polish consumer offering; this English version explains the same terms. Mandatory consumer protections apply regardless of language.
1. Service provider and contact
The Service is operated by PROJEKT ARKAD SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, abbreviated Projekt ARKAD Sp. z o.o. (we, us), a Polish limited liability company registered in the Rejestr Przedsiębiorców of the National Court Register:
- KRS: 0001253732
- NIP: 6772544772
- Registry court: Sąd Rejonowy dla Krakowa Śródmieścia w Krakowie, XI Wydział Gospodarczy Krajowego Rejestru Sądowego
- Registered office and correspondence address: ul. Kazimierza Morawskiego 5/127, 30-102 Kraków, Poland
- Share capital: PLN 15,000.00
- Email for support, complaints, withdrawal, and legal notices: [email protected]
ARKAD Wallet is the product name. The company is responsible for providing the Service and handling personal data as described in the Privacy Policy.
Support is available by email at [email protected], through our Telegram bot, or by messaging our ARKAD Wallet Facebook page. Our team handles support messages manually. Email and the postal address above remain available for complaints, withdrawal, and legal or privacy notices; you do not need a Telegram or Facebook account to exercise those rights.
2. Service and technical requirements
ARKAD Wallet supports budgeting, manual and voice-assisted transaction entry, account and goal tracking, analytics, net worth views, and the ARKAD Aura progress indicator. Premium also provides bank transaction imports through Kontomatik. The Free plan remains available without a bank connection.
You need a compatible iOS or Android device, the operating-system version and storage specified in the current store listing, and an email address or supported sign-in method. An internet connection is needed for registration, authentication, synchronization, voice processing, subscription verification, and bank imports. Some locally stored budgeting functions are available offline. Voice input requires microphone permission. Your internet/mobile provider's usual charges may apply.
We provide updates, including security updates, necessary to keep the Service in conformity with the contract for the period required by law, and inform you of their availability. Install necessary updates within a reasonable time. Any consequences of not installing them are subject to statutory consumer protections.
The Service provides tools for budgeting, tracking and understanding your finances. ARKAD Aura and Smart insights explain budgeting progress; they do not provide personalised investment recommendations, tax or legal advice, or individual professional financial advice. The Service does not hold your money or initiate payments from your bank. AI-assisted drafts and financial indicators can contain errors; review them before relying on them. Bank imports are not automatically categorized in ARKAD. These explanations do not exclude our responsibility for conformity of the Service with the contract.
3. Eligibility, account creation, and duration
The Service is for personal, non-business use by people aged 16 or older. Users under 18 must have a parent or guardian's consent where legally required, including for paid subscriptions. A bank may impose additional eligibility and authorization requirements.
The account-service contract is concluded when you complete registration and accept these Terms. The Free account service continues until you or we end it under these Terms. Premium is a separate paid upgrade for the billing period selected and confirmed in the store. We make the applicable Terms available for saving and provide the contract confirmation on a durable medium, such as email, as required by law; the store also provides purchase confirmation.
Existing users may expressly agree to this revision through the app. We record the accepted version and acceptance time. If you do not agree, contact us using Section 1 to discuss your existing contractual rights, end the account contract, or request recovery of your content and any applicable remedies. Refusal does not constitute acceptance or itself waive rights relating to prepaid Premium or your data. An acknowledgment of the Privacy Policy is separate from agreement to these Terms and does not authorize optional analytics, marketing, or bank access.
Keep your sign-in credentials secure and tell us about suspected unauthorized access. Financial accounts inside ARKAD (such as cash or savings) are distinct from your login account and from bank connection slots. Only connect bank accounts you are authorized to access and share.
4. Free plan and Premium
The v4.0 offering is summarized below. It reduces the Free voice allowance from 30 to 10 inputs per calendar month and makes the detailed Aura component results and explanations available as Premium Smart insights. The overall Aura score stays available in Free. Applying these changes to an existing contract remains subject to agreement as described in Section 3, the applicable change process, notice, and consumer rights in Section 10; publication alone does not activate them for an existing contract.
| Feature | Free | ARKAD Wallet Premium |
|---|---|---|
| Budgeting and manual transaction entry | Included | Included |
| Voice input | 10 inputs per calendar month | Unlimited |
| Overall ARKAD Aura score | Included when enough data is available | Included when enough data is available |
| Smart insights: detailed Aura component results and explanations | Not included | Included |
| Bank imports through Kontomatik | Not included | Up to three connection slots per ARKAD user account; Section 5 applies |
| Priority support | Not included | Included |
The Free voice allowance resets at 00:00 UTC on the first day of the month. Unused voice inputs do not carry over. After using the allowance, you can continue entering transactions manually, wait for the next monthly reset, or obtain Premium for unlimited voice input.
Smart insights and bank integrations require active Premium access. The bank benefit is subject to the counting, monthly slot reservation and refresh rules in Section 5. “Unlimited” voice input does not mean unlimited bank connections or refreshes.
ARKAD Aura provides an overall score from 0 to 100, where enough data is available. The score remains available in Free; Premium unlocks Smart insights for your budget, the detailed component results and explanations: “You spend as planned,” “Your money has jobs,” “You track often,” and “You save for later.” These cover spending against your plan, allocation of money, tracking habits, and savings/investment progress. When Premium access ends, Smart insights become unavailable while the overall score remains available in Free. These indicators explain budgeting progress; they are not a bank credit score or individual professional financial advice.
Premium is offered in weekly and yearly billing periods. The total price, currency, applicable taxes, billing period, and any promotional conditions are displayed before you confirm the purchase. The store's checkout offer governs the price of that purchase. Any trial or referral benefit, including a qualifying invited friend's 30 days of Premium at no cost, is governed by the conditions displayed for that offer; it does not make the Free plan a trial.
5. Bank connections through Kontomatik
5.1 Provider, authorization, and coverage
Bank access is provided through Kontomatik sp. z o.o., ul. Bonifraterska 17, 00-203 Warsaw, Poland, KRS 0000338706, an open banking account information service provider. Its terms and privacy information are available in the authorization flow. See Kontomatik's documents for users, under Kontomatik sp. z o.o. Section 4 of the Privacy Policy explains Kontomatik's processing roles and use of anonymized information.
Kontomatik provides the regulated account information service under its own agreement with you. ARKAD provides the separate budgeting and Premium service under these Terms; Kontomatik is not a party to your ARKAD contract. Kontomatik's AISP registration does not mean ARKAD itself holds that registration. Conditions or withdrawal acknowledgments in the provider's authorization flow do not waive your rights under your separate ARKAD contract.
You choose whether to authorize bank access. ARKAD receives data through Kontomatik; we do not receive or store your bank login password or PIN. ARKAD does store the connection identifiers and access authorization metadata needed for importing, as described in the Privacy Policy. Bank authentication and any renewed authorization take place through the bank/provider flow. One multiple-access authorization allows data fetching for up to 180 days. Bank constraints or revocation may shorten that period. After expiry or revocation, further imports require renewed authorization; an active Premium subscription does not itself extend the authorization.
Coverage focuses on supported Polish banks. Check the banks available in the app before buying Premium for this feature. Kontomatik's coverage page is a reference; not every provider-listed bank or access mode is necessarily available in ARKAD. Changes to availability remain subject to Sections 8 and 10.
You can link bank accounts to existing ARKAD financial accounts or create new ones from a connection. Imported transactions are marked as imported and uncategorized; you assign categories manually.
5.2 Three connection slots
Premium includes three bank connection slots per ARKAD user account, shared across the devices on which you use that account. A connection is established through one bank login and can contain multiple accounts at that bank; those accounts share one slot and refresh together. For example, a current account and savings account available through the same bank login use one slot. A separately established connection through another login at the same bank uses another slot. The limit counts bank connections, not each individual bank account or IBAN within a connection.
Each successfully established connection has monthly slot periods anchored to its original connection date and time. Disconnecting stops further imports but keeps the slot occupied until the end of the current period. This is a calendar-month period measured from the connection date, not a fixed 30 days and not a reset on the first of the month. Disconnection does not start a new one-month waiting period.
For example, connecting on 15 January and disconnecting on 20 January keeps that slot occupied until 15 February. If you keep that connection active into the next period and disconnect on 20 February, the slot becomes free on 15 March, at the original connection time. If all three slots are occupied, you must wait for a slot to become free before establishing a new connection. You can use another free slot immediately. A disconnected connection cannot be restored; connecting again, including to the same bank, requires a new authorization and an available slot.
If the original day does not exist in a later month, that month's boundary is its last day, preserving the original anchor for later months: a 31 January connection has a boundary on 28 February (29 in a leap year), then 31 March. Boundaries follow the original connection time, calculated in UTC. A connection that stays active continues to occupy its slot across periods. Slot periods are separate from Premium billing periods and bank authorization expiry. They do not create an additional charge beyond the Premium price disclosed at checkout.
5.3 Refreshes and data availability
The normal schedule is three automatic refreshes per day, plus one additional manual refresh per bank connection per day, subject to bank/provider availability and the applicable import limit. The manual allowance is consumed when the request is accepted; it does not guarantee a successful import. The daily reset follows the Service's server calendar day. Kontomatik multiple access is limited to a maximum of four data fetches within 24 hours under the relevant authorization; the bank may impose additional restrictions. Initial imports and other requests may use the same allowance. Resetting ARKAD's daily manual-refresh allowance therefore does not guarantee that the provider already allows another fetch.
Imports are not real-time. Banks may publish transactions later than they appear in their own app; pending transactions or authorization holds may be missing, change, settle later, or be released. Any pending data made available is provisional. A delay of one or two days or longer can occur. A refresh cannot make a bank finalize or publish a transaction sooner. Bank balances and ARKAD balances can differ, for example because of manual entries or timing; check discrepancies before relying on the displayed figures.
For an error or missing transaction, contact us with the bank name, approximate date, and error message, without passwords, PINs, or one-time codes. Kontomatik's status page may show a bank/provider incident. These limitations do not remove your statutory remedies for a service that does not conform to the contract.
5.4 Disconnection and Premium expiry
You can disconnect a bank in the app. We stop further imports from the disconnected connection and request revocation of its provider access. A provider outage may delay completion of revocation. You can also use any revocation controls offered by your bank/provider.
Kontomatik's published terms also let you cancel multiple access by emailing [email protected] from the email used in its authorization tool, with information needed to identify the access. They provide for completion within two working days. If you did not supply an email in that tool, contact Kontomatik or ARKAD support for help identifying the access; never send bank passwords, PINs or one-time codes. Cancelling provider access does not by itself cancel Premium renewal or erase ARKAD history.
Disconnection does not itself erase imported transactions from your ARKAD history. When Premium access ends, bank importing is no longer available and connections are disconnected; previously imported history remains in your account under the Privacy Policy. Slot retention still follows Section 5.2. A later Premium purchase does not automatically restore revoked bank authorization. You may need to authorize a new connection, subject to available slots.
6. Payments, renewal, and cancellation
Payments are processed through the Apple App Store or Google Play. We do not collect payment card details. RevenueCat supports subscription entitlement tracking.
Subscriptions renew automatically for the selected billing period unless you turn off renewal through the store before its displayed renewal deadline. The store shows your renewal date, charge, and applicable cancellation conditions. You can manage subscriptions through Apple account settings or Google Play → Payments & subscriptions → Subscriptions. Contact us if you need help locating these controls.
Turning off renewal ordinarily keeps Premium available until the paid period ends. Deleting the app or your ARKAD account does not itself cancel the store subscription; cancel renewal separately to prevent future charges. After Premium expires, the Free plan remains available if your account is still open. Statutory withdrawal and remedies are separate from cancellation of future renewal.
Price changes apply only prospectively, after the legally required notice and any consent required by law or the store. They do not change a period already paid for. You can cancel renewal before an increased price applies.
Store purchase refunds: request a refund for an App Store purchase through Apple's refund service, or follow Google Play's refund instructions for a Google Play purchase. The store handles the payment transaction and payment-method reimbursement under its applicable purchase terms and mandatory law. ARKAD does not operate a separate in-app payment or refund system and cannot guarantee that a store will approve a request. We can help with purchase identification, access problems, and any steps required of us under applicable law or the store arrangements. You can still send statutory complaints or notices concerning your contract with ARKAD directly to us; the store process does not exclude our consumer obligations.
7. Fourteen-day withdrawal right
Store-billed purchases: use the relevant store's refund/withdrawal route in Section 6 for the purchase transaction. The applicable store terms identify the seller and describe the withdrawal process and any legally valid exceptions or acknowledgments given at checkout. Turning off renewal, requesting a refund, and exercising a statutory withdrawal right are different actions. These Terms do not promise an unconditional refund of every Premium purchase or every renewal.
For a distance contract with ARKAD, consumers may withdraw within 14 days of its conclusion, without giving a reason, where the statutory withdrawal right applies. This also covers a Free digital-service contract where it falls within consumer law. Starting an ongoing service or accepting these Terms does not by itself waive that right. Store billing does not remove mandatory rights arising from your separate contract with ARKAD.
For withdrawal from your contract with ARKAD, send an unequivocal statement to [email protected] or our postal address in Section 1 before the deadline. You may use the optional form below. We acknowledge an email withdrawal on a durable medium. The form is addressed to ARKAD; for a store purchase transaction, use the store's own route or form.
Where the law permits charging for performance before withdrawal, any proportionate amount is due only if you expressly requested an early start and received the required information. Exceptions for fully performed services or digital content apply only when all statutory conditions, including separate prior express consent, acknowledgment of loss of the right, and required confirmation, have been met. We do not treat a general acceptance checkbox as that separate consent.
Where withdrawal from a contract with us gives rise to a refund legally due from us, it is due without undue delay and within 14 days of receiving the withdrawal statement. Store-billed payment refunds are processed through the relevant store rather than a separate ARKAD checkout, using the original payment method unless you expressly agree to another method at no cost. We take any steps required of us to fulfill our own obligations; platform processing does not exclude them. Mandatory rights under your country of residence remain unaffected.
Optional withdrawal form
To: Projekt ARKAD Sp. z o.o., ul. Kazimierza Morawskiego 5/127, 30-102 Kraków, Poland; [email protected].
I notify you that I withdraw from my contract for the following service: ______.
Contract date: ______.
Consumer name and address: ______.
Account email / order reference (to help identify the contract): ______.
Date: ______. Signature (only if sent on paper): ______.
8. Complaints and conformity of the Service
We are responsible for providing a digital service that conforms to the contract under applicable law, including the Polish Consumer Rights Act. This includes conformity throughout the agreed period of continuous supply and required updates. If the Service is not supplied or does not conform, you may request supply or restoration of conformity and, in the circumstances provided by law, a price reduction or withdrawal from the contract. Restoration must take place within a reasonable time, without charge or excessive inconvenience. Statutory refunds following a price reduction or withdrawal are due within the applicable 14-day period.
Send complaints to our email or postal address, describing the issue, when it occurred, the affected account/order, and the remedy you request. Missing optional details do not invalidate a complaint. We respond on paper or another durable medium, such as email, within 14 days of receipt, unless a different statutory period applies. Where Polish law so provides, failure to respond within that period means the complaint is accepted.
Complaints about Kontomatik's own account-access service can also be sent directly to [email protected] or to its address in Section 5.1. Kontomatik's published access-service terms provide for a response within 15 working days, or up to 35 working days in particularly complex cases with an explanation. That separate procedure does not extend ARKAD's complaint deadline or require you to contact Kontomatik before exercising rights against us.
You may seek help from a municipal/district consumer ombudsman or consult UOKiK's consumer information and ADR information. Participation in an out-of-court procedure follows the applicable rules and any required agreement. You remain free to bring a claim before the competent court.
9. Acceptable use, intellectual property, and liability
Do not use the Service unlawfully, supply unlawful content, access another person's data without authorization, undermine security, overload the Service, bypass subscription/connection limits, or resell the Service without permission. Restrictions on reverse engineering do not override rights expressly permitted by law, including applicable interoperability exceptions.
The Service's software and branding belong to us or our licensors. We grant you a personal, non-exclusive, non-transferable right to use the Service under these Terms. You retain your rights in content you provide; we use it to deliver the Service and as explained in the Privacy Policy.
You make your own financial decisions. We do not guarantee a particular savings amount, profit or investment return from using the Service, ARKAD Aura or Smart insights. Our liability for providing the Service is determined by applicable law. Your mandatory consumer remedies and rights to damages remain fully available. Nothing excludes liability that cannot lawfully be excluded.
10. Changes, suspension, and termination
We may make necessary changes to comply with law, address security threats, or preserve conformity. Other changes to the ongoing Service may be made for justified reasons: changes in supported operating systems or bank/provider interfaces; replacement of a discontinued supplier; or improvements to functionality, accessibility, or reliability. Such service changes are made without additional cost to you, and we explain them clearly. A separately agreed future subscription price change follows Section 6; it is not a fee for making a service change.
For a change that materially and negatively affects access or use, we give advance notice on a durable medium describing the change, its date, and your rights. You may terminate without notice within 30 days of the change or the later notification, as provided by law, unless we enable you to retain the unchanged, conforming Service without additional cost. Statutory settlement and refund rights apply.
Changes to these Terms must be tied to the reasons above, changes in our company/contact details, or changes in law. We send the revised terms and explanation by email or another durable medium normally at least 14 days before they take effect; urgent legal/security changes may require shorter notice with reasons. We do not apply changes retroactively or use continued use to obtain consent where separate consent is legally required. You may end the account contract before an ordinary change takes effect without a termination charge; mandatory refund and other rights remain available.
You may end the account contract at any time by deleting your account in the app or contacting us. We may suspend access to address a concrete security threat, fraud, unlawful activity, or a material breach. Measures must be proportionate. Where possible, we explain the reason and give an opportunity to remedy it before ending the contract; immediate action may be necessary for urgent security or legal reasons. You can challenge the decision through the complaint process.
If we discontinue the Service, we provide reasonable advance notice and an opportunity to retrieve your data, and refund any unused prepaid service we can no longer provide. Your rights to recover user-provided or generated content on termination, in a commonly used machine-readable format where required by law, remain unaffected. Data deletion and lawful retention follow the Privacy Policy.
11. Communications and privacy
We send necessary service messages concerning accounts, security, subscriptions, and legal changes. Optional product news, surveys, and tips require separate consent where required by law; refusing does not prevent use of the Service. You can unsubscribe using the link in the message or by contacting us.
The Privacy Policy explains personal-data processing and your choices. It is an information notice, not blanket consent to optional processing.
12. Governing law
Polish law applies. This choice does not deprive consumers of mandatory protections of the law applicable in their country of habitual residence. Disputes go to the courts competent under applicable law; these Terms do not impose an exclusive court in Kraków on consumers.
